DECLARATION OF TRUST 1. Frances Gardner of Bath Somerset, widow and John Thruston of Weston Hall, Suffolk, esq. 2. Valentine Gardner of Play ford, Somerset, esq. Frances Gardner and John Thruston have become sureties for Valentine Gardner’ s observance of E.I.C.’s regulations and external with bond for £2,000. Valentine Gardner has been licensed by East India Company to trade a merchant in accordance with 53 Geo.III and terms of indenture dated April 28th 1819 By indenture of November 13th, 1792 between A. Valentine Gardner senior (deceased) B. Frances Gardner nee Thruston c. Rt. Hon. Allen Garner and Samuel Holworthy (both deceased) marriage settlement (Valentine Gardner junior only issue of marriage) Frances entitled to interest on £3,000 3% annuities later held in name of Rev. Samuel Holworthy of Croxwell Staffs., and Rev. John Silver Surrbridge of Stratton upon Dunsmore, Warcs., (successors of c.) for life. Valentine Gardner junior entitles to principal. Holworthy and Surrbridge at request of Frances Gardner and Valentine Gardner transferred £550 stock to Frances. Valentine junior agreed to identify Frances Gardner and John Thruston £2,450 stock to be transferred to them on trust. Holworthy and Surrbridge duly transferred 1. may identify subs from dock if 2. breaks regulation and bond is forfit. Frances to enjoy interest in the meantime. On Frances’ death or cancellation of bond, stock to be transferred to Valentine junior. Pronsia for replacement of a trustee.
